1Agreement
These Terms of Service ("Terms") govern your use of hostingstall.com, our client area and every service you order from HostingStall ("we", "us"), including web hosting, dedicated servers, Mac mini servers, cloud VPS, managed services and Bring Your Own IP. By ordering or using a service, you agree to these Terms.
Our Acceptable Use Policy, Privacy Policy, Refund & Cancellation Policy and Service Level Agreement form part of these Terms. You must be at least 18 years old to order. If you order on behalf of an organisation, you confirm that you have authority to bind it.
2Your account
- Give us accurate contact and billing information and keep it up to date.
- Keep your client area password and server credentials secure. You are responsible for all activity under your account.
- We may ask you to verify your identity or payment, and we may refuse or cancel orders that fail our fraud checks.
3Orders and setup
We start setting up a service once your payment is confirmed and any verification is complete. Setup times shown on our website are estimates: instant servers are activated automatically after payment, while custom servers and Mac minis can take from a few days to a week. If we cannot provide a service you have paid for, we will cancel the order and refund you in full.
4Billing and payment
- Prices are shown in US dollars unless stated otherwise. Applicable taxes are added to your invoice.
- Services are billed in advance for the billing period you choose and renew automatically until cancelled. Invoices are issued before each due date.
- You can pay using the methods on our How to Pay page. Please quote your invoice number with bank transfers.
- If an invoice is unpaid 3 days after its due date, the service may be suspended. If it is unpaid 14 days after its due date, the service may be terminated and its data permanently deleted.
- We may change prices for future billing periods with at least 30 days' notice.
5Cancellation
You can cancel any service from the client area by submitting a cancellation request, either immediately or at the end of the current billing period. Refunds are covered by our Refund & Cancellation Policy. When a service ends, its data is deleted, so please take your own backup before cancelling.
6Your responsibilities
- Use our services lawfully and in line with our Acceptable Use Policy.
- On servers where you have root or administrator access, you act as the system administrator: you are responsible for securing the operating system, applications and passwords, and for keeping software up to date.
- Hold valid licences for any software you install yourself.
- You are responsible for the actions of your own customers and users on your services.
7Backups and data
Unless your plan includes backups (such as the daily backups on our web hosting plans) or you have ordered our Backups service, you are responsible for backing up your data. Even with our backups in place, we recommend keeping your own copy of important data. We are not liable for loss of data.
8IP addresses
IP addresses we assign to you belong to our network (AS132563) and remain our property. They cannot be transferred and are returned to us when the service ends. Additional IPv4 addresses require a valid technical reason. If you use our Bring Your Own IP service, you must hold the rights to the address space and ASN you ask us to announce.
9Resource usage and fair use
Unlimited bandwidth on web hosting covers the normal operation of websites. It does not cover using a hosting account as file storage, a backup target or a download mirror. If an account affects the performance of other customers, we may limit it or ask you to move to a larger plan. Dedicated server traffic allowances are shown on each plan; usage above the allowance may be billed or the port speed reduced.
10Support and managed services
Support is available 24x7x365 through tickets, phone and email. The scope of each managed service is described on its page. To carry out work you request, our engineers may need to access your service. We make reasonable efforts with third-party software but cannot guarantee fixes for software we did not supply.
11Suspension and termination by us
We may suspend or terminate a service for non-payment, fraud, a breach of these Terms or the Acceptable Use Policy, a legal requirement, or activity that threatens our network or other customers. Where possible we will give notice first, but we may act immediately in urgent cases. No refund is due for a service terminated because of a breach.
12Service levels
Our network uptime commitment and the service credits available if we miss it are set out in our Service Level Agreement. Service credits are your sole remedy for downtime.
13Third-party software and licences
Software such as Windows Server, cPanel, Plesk and CloudLinux is provided under its vendor's licence terms, which you agree to follow. If a vendor changes its licence price, we may change the price of that licence with notice.
14Limitation of liability
Apart from the commitments in our SLA, services are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or business. Our total liability for any claim is limited to the fees you paid for the affected service in the 3 months before the claim arose.
15Indemnity
You agree to indemnify us against claims, losses and costs arising from your content, your use of our services or your breach of these Terms.
16Events outside our control
We are not responsible for failures caused by events beyond our reasonable control, such as natural disasters, power grid failures, government action, war, or failures of third-party networks.
17Changes to these Terms
We may update these Terms from time to time. The current version is always on this page with its last-updated date. We will email you about significant changes at least 14 days before they take effect. Continuing to use our services after that means you accept the updated Terms.
18Governing law
These Terms are governed by the laws of India. The courts at Berhampore, West Bengal have jurisdiction over any dispute.
